1. General information

Terms and conditions: we welcome and thank users for their interest in rviews press (aka “rviews press, marseille, france” “its journals and preprint platforms” “we,” “our,” or “us”).

Unless otherwise noted on a particular site or service, these terms and conditions of use (“terms and conditions”) apply to their use of all or part of the websites that rviews press operates. These include https://rviews.org, https://pp.rviews.org, and https://ark.rviews.org, together with all other subdomains thereof, (collectively, the “websites”). The terms and conditions also apply to all products, journals, preprint platforms, information, and services provided through the websites, including the community of reviewers and editorial advisors.

Additional terms: in addition to the terms and conditions, their use of any services may also be subject to specific terms applicable to a particular service (“additional terms”). If there is any conflict between the additional terms and the terms and conditions, then the additional terms apply in relation to the relevant service.

Collectively, the terms: the terms and conditions, together with any additional terms, form a binding legal agreement between users and rviews press, marseille, france in relation to their use of the services. Collectively, this legal agreement is referred to below as the “terms.”

Human-readable summary of sec 1: these terms, together with any special terms for particular websites, create a contract between users and rviews press. The contract governs their use of all websites operated by rviews press, unless a particular website indicates otherwise. These human-readable summaries of each section are not part of the contract but are intended to help users understand its terms.

 

2. Their agreement to the terms

By clicking “I accept” or otherwise accessing or using any of the services (including the pubishing, edition, improvement and all other proposed service users acknowledge that users have read, understood, and agreed to be bound by the terms. By clicking “i accept” or otherwise accessing or using any services users also represent that users have the legal authority to accept the terms on behalf of themself and any party users represent in connection with their use of any services. If users do not agree to the terms, users are not authorized to use any services. If users are an individual who is entering into these terms on behalf of an entity, users represent and warrant that users have the power to bind that entity, and users hereby agree on that entity’s behalf to be bound by these terms, with the terms “you,” and “their” applying to you, that entity, and other users accessing the services on behalf of that entity.

3. Changes to the terms

From time to time, Rviews Press may change, remove, or add to the terms, and reserves the right to do so in its discretion. In that case, we will post updated terms and indicate the date of revision. If we feel the modifications are material, we will make reasonable efforts to post a prominent notice on the relevant website(s) and notify those of users with a current Rviews Press login service account via email. All new and/or revised terms take effect immediately and apply to their use of the services from that date on, except that material changes will take effect 30 days after the change is made and identified as material. Their continued use of any services after new and/or revised terms are effective indicates that users have read, understood, and agreed to those terms.

4. No medical, technological or legal advice

Rviews press is not a medical, research or law institution, does not provide any medical, research or legal advice, and is not a substitute for medical, research or law institution. Rviews Press aims a publishing scientific content that were prepared by authors from research and medical institution. Rviews Press and people working for Rviews Press services may also publish content based on the literature, make comment on the state of art of fields in life science. But these comments and explanations are not in any circumstance advice and cannot be substitutes to the effort of research or medical or legal institutions. Sending email or using any of the services, including the articles, their summary, figures, idea and all derivatives, licenses, does not constitute advice for medication or create an such kind of relationship.

Human-readable summary of sec 4: People working in relation the publishing activity of Rviews Press are experts in life science and physians, but non of them are the readers physician. Please consult the your awn physian or your technological commercial or own attorney if users need specific advice.

 

5. Content available through the services

Provided as-is: users acknowledge that Rviews Press does not make any representations or warranties about the material, data, and information, such as data files, text, computer software, code, music, audio files or other sounds, photographs, videos, or other images (collectively, the “content”) which users may have access to as part of, or through their use of, the services. Under no circumstances is Rviews Press liable in any way for any content, including, but not limited to: any infringing content, any errors or omissions in content published by authors, or for any loss or damage of any kind incurred as a result of the use of any content posted, published, transmitted, linked from, or otherwise accessible through or made available via the services deployed by Rviews Press. Users understand that by using the services, they may be exposed to content that is offensive, indecent, or objectionable.

Users agree that users are solely responsible for their reuse of content made available through the services, including publishing, authoring and readership services. Users should review the terms of the applicable license before they use the content so that users know what they can and cannot do.

Copyright: Rviews Press is sensitive to the intellectual property although convinced of the need of promoting public knowledge acquisition and access to scientific data. The authors retain the copyright of their publications published by Rviews Press journals under the license CC BY 4.0 International. However, Rviews Press, Marseille, France is the owner or received the adequate license of the intellectual right in all the Sites including those of journals and preprints platform, unless otherwise indicated. All those rights are reserved. We and the contributors identified the authors of contents must be adequately acknowledged for any specific content. We are willing also to acknowledge and agree that all other party retain the ownership in all copyright they may have in a content published in our platforms including journal articles and manuscripts preprints. Rviews Press reserves the right to remove any content that is proved to be resulted from an infringement of copyright or in legal dispute. In such situations, all the necessary third parties involved the distribution and publicity of the published content will be informed and the required action will be taken to remove the content as far as possible. However, Rviews Press is publishing materials in open access, which may make the information spreading quick rapid. Thus, we cannot ensure that the published material will be completely removed from internet.

Licensing: The external experts- authored contents including articles and preprints as well as their derivatives;  Rviews Press-owned content: other than the text of Rviews Press licenses, infographics, images, videos and all multimedia materials which are made available under the CC BY public domain dedication, Rviews Press trademarks (subject to the trademark policy), and the software code, all content on the websites is licensed under the CC BY attribution 4.0 license, unless otherwise marked. See the Creative commons policies page for more information.

Human-readable summary of sec 5: we try our best to have useful information on our sites, but we cannot promise that everything is accurate or appropriate for their situation. Content on the site is licensed under CC BY 4.0 unless it says it is available under different terms. If users find content using Rviews Press search, be sure to independently verify the license terms, attribution, and other copyright information before using it.

 

6. Content supplied by users and authors

User and author responsibility: users and authors represent, warrant, and agree that no content posted (e.g preprints) or published (e.g. article) or otherwise shared by users on or through any of the services (“their content”), violates or infringes upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, breaches or conflicts with any obligation, such as a confidentiality obligation, or contains libelous, defamatory, or otherwise unlawful material.

Licensing author (their) content: authors retain any copyright that they may have in their content. Authors hereby agree that their content: (a) is hereby licensed under the CC BY attribution 4.0 license and may be used under the terms of that license or any later version of a creative commons attribution license, or (b) is in the public domain (such as content that is not copyrightable or content authors make available under CC0), or (c) if not owned by the authors, (i) is available under a cra creative commons attribution 4.0 license or (ii) is a media file that is available under any creative commons license or that the authors are authorized by law to post or share through any of the services, such as under the fair use doctrine, and that is prominently marked as being subject to third party copyright. All of their content must be appropriately marked with licensing (or other permission status such as fair use) and attribution information if required or adequate.

Removal: Rviews Press may, but is not obligated to, review all the content posted or published as long as they follow the editorial policies as defined for all journals. The preprints manuscript posted on PRviews platform are only moderated by not evaluated, reviewed or edited. For the evaluated and reviewed materials, Rviews Press cannot warranty that all aspects follow the law and is not responsible of any infringement of any sort following a publication or posting on our platform. However, as stated above for copyright infringement, we reserve all right to delete or remove their content (without notice) from any of the services in its sole discretion as well as conduct all the necessary legal action for the material retraction. But we cannot warranty successful definitive suppression from internet after publication, specially in the case of the open access articles. Removal of any of the author content from the services (by authors or Rviews Press) does not impact any rights users granted in their content under the terms of a Rviews Press license.

Human-readable summary of sec 6: we do not take any ownership of author content unless the materials authored by Rviews Press employees when users post or publish on our sites. If users post content they own, they agree it can be used under the terms of CC BY 4.0 or any future version of that license. If users do not own the content, then users should not post or publish it unless it is in the public domain or licensed CC BY 4.0, except that they may also post pictures and videos if they are authorized to use them under law (e.g., fair use) or if they are available under any creative commons license. Users referred also as author when they create published content, must also note that information on the file when they upload it. Users are responsible for any content they send to Rviews Press or upload to our sites.

 

7. Participating in the Rviews Press platform, mission and community: registered users

By registering for an account through any of the services, including securing a Rviews Press login service account, or applying for membership to the editorial advisory board, or accepting to become a reviewer, users represent and warrant that they are the age of majority in their jurisdiction (typically age 18). Services offered to registered users are provided subject to these terms and conditions, the Rviews Press privacy policies, and hereby incorporated by reference into these terms.

Registration: users agree to (a) only provide accurate and current information about themself, (b) maintain the security of their passwords and identification, (c) promptly update the email and mailing addresses listed in connection with their account to keep it accurate so that we can contact them, and (d) be fully responsible for all uses of their account. Users must not set up an account on behalf of another individual or entity unless users are authorized to do so.

No membership in Rviews Press: creating a Rviews Press login service account or using any of the related websites or services for improved reader experience, authoring activity, manuscript reviewing or advisory editorial role, including becoming a member of the editorial advisory board of journals of Rviews Press, does not and shall not be deemed to make the user a member, shareholder or affiliate of Rviews Press, Marseille, France for any purposes whatsoever, nor shall users have any of the rights of statutory members as defined law. Rviews Press through its published journals and media aims at promoting the recognition the reviewer and editorial advisory roles, and fostering an inclusive publishing model that support the sustainable implication of scientist around the world, young scientists and independent researchers. Following this measure, the editorial advisors and the reviewers involved in a publication project are recognized by including their name in the published material in a dedicated section. Their responsibilities remain limited to their role of evaluator and helper for improving the communication of the authors’ works. In any way, they are lied to the reality of the published content during and after publication. However, it is their responsibility to alert about any doubt on eventual infringement they may have known. Rviews Press also provides incentives and gratifications to the participants in the evaluation of manuscripts in form of vouchers, article publication waiver or cash credit. These incentives are not salaries and not intended to substitute to salaries. They are given in most cases to individuals who are already employed by institutions and are not employed by Rviews Press. The incentives are uniquely for the sole purpose of encouraging the commitment of all in manuscript evaluations. This measure is consistent with the mission of Rviews Press and is part of the terms claimed here to define the interaction between our journals and reviewers or editorial advisors.

 

Termination: Rviews Press reserves the right to modify or discontinue the accounts of authors or the membership of reviewers or editorial advisors at any time for any reason or no reason at all.

Human-readable summary of sec 7: Users aka authors or reviewers or editorial advisors do not register for an account on our sites unless they are >18 years old. Rviews press has the right to end their account at any time. Users are responsible for use of their account. And of course, we invite them to do not set up an account for someone else unless users have permission to do so. Setting up an account doesn’t make users a member of Rviews Press.

 

8. Prohibited conduct

Users agree not to engage in any of the following activities:

1. Violating laws and rights:

  • Users may not (a) use any service for any illegal purpose or in violation of any local, state, national, or international laws, (b) violate or encourage others to violate any right of or obligation to a third party, including by infringing, misappropriating, or violating intellectual property, confidentiality, or privacy rights.

2. Solicitation:

  • Users may not use the services or any information provided through the services for the transmission of advertising or promotional materials, including junk mail, spam, chain letters, pyramid schemes, or any other form of unsolicited or unwelcome solicitation.

3. Disruption:

  • Users may not use the services in any manner that could disable, overburden, damage, or impair the services, or interfere with any other party’s use and enjoyment of the services; including by (a) uploading or otherwise disseminating any virus, adware, spyware, worm or other malicious code, or (b) interfering with or disrupting any network, equipment, or server connected to or used to provide any of the services, or violating any regulation, policy, or procedure of any network, equipment, or server.

4. Harming others:

  • Users may not post or transmit content on or through the services that is harmful, offensive, obscene, abusive, invasive of privacy, defamatory, hateful or otherwise discriminatory, false or misleading, or incites an illegal act;
  • Users may not intimidate or harass another through the services; and, users may not post or transmit any personally identifiable information about persons under 13 years of age on or through the services.

5. Impersonation or unauthorized access:

  • Users may not impersonate another person or entity, or misrepresent their affiliation with a person or entity when using the services;
  • Users may not use or attempt to use another’s account or personal information without authorization; and
  • Users may not attempt to gain unauthorized access to the services, or the computer systems or networks connected to the services, through hacking password mining or any other means.

9. Rviews Press editorial and reviewing network

By submitting their application or after invitation to become a member of the Rviews Press editorial or reviewer board, we acknowledge that users have read, understood, and, in the role, users are accepted for membership, agree to be bound by the specific editorial policies and mission and vision of Rviews Press. If users are admitted, these terms and the editorial policies shall govern their use of and participation in the editorial process, including their participation in any forum operated by the Rviews Press editorial and reviewing network, such as platforms, journal and publication projects including special issues.

10. Disclaimer of warranties

To the fullest extent permitted by applicable law, Rviews Press, its founder Adama Sidibé, employees and partners offers the services (including all content available on or through the services) as-is and makes no representations or warranties of any kind concerning the services, express, implied, statutory, or otherwise, including without limitation, warranties of title, merchantability, fitness for a particular purpose, or non-infringement. Rviews Press does not warrant that the functions of the services will be uninterrupted or error-free, that content made available on or through the services will be error-free, that defects will be corrected, or that any servers or externally outsourced services used by Rviews Press are free of viruses or other harmful components. Rviews Press does not warrant or make any representation regarding use of the content available through the services in terms of accuracy, reliability, or otherwise.

11. Limitation of liability

To the fullest extent permitted by applicable law, in no event will Rviews Press be liable to users on any legal theory for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including without limitation, loss of revenue or income, lost profits, pain and suffering, emotional distress, cost of substitute goods or services, or similar damages suffered or incurred by users or any third party that arise in connection with the services (or the termination thereof for any reason), even if Rviews Press has been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Rviews Press is not responsible or liable whatsoever in any manner for any content posted on or available through the services (including claims of infringement relating to that content), for their use of the services, or for the conduct of third parties on or through the services.

Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to users. In these jurisdictions, the foregoing exclusions and limitations will be enforced to the greatest extent permitted by applicable law.

12. Indemnification

To the extent authorized by law, users agree to indemnify and hold harmless Rviews Press, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting directly or indirectly from or arising out of (a) their violation of the terms, (b) their failure to verify the copyright license, attribution, and other information associated with content resulting from their use of Rviews Press search, (c) their use of any of the services, and/or (d) the content users make available on any of the services.

13. Privacy policies

Users are invited to review the privacy policies so they are aware of how we collect and use their personal information.

14. Trademarks

Rviews Press’s name as well as those of its derivative services including the journals and preprint platform names, logos, icons, and other trademarks may only be used in accordance with our trademark policy, which is incorporated by reference into these terms and conditions. Please review the trademark policy so users understand how Rviews Press’s trademarks may be used.

Other trademarks used on the site are the registered trademarks of their respective owners. Those marks are used for referential purposes only and are not intended to suggest or imply any affiliation with or endorsement by their respective owners.

15. Copyright complaints

Rviews Press respects copyright, and we prohibit users of the services from submitting, uploading, posting, publishing or otherwise transmitting any content on the services that violates another person’s proprietary rights.

To report allegedly infringing content hosted on a website owned or controlled by Rviews Press or on a webpage of hosted on our domain name, please send a notice of infringing materials to support@rviews.org.

16. Termination

By Rviews Press: Rviews Press may modify, suspend, or terminate the operation of, or access to, all or any portion of the services at any time for any reason. Additionally, their individual access to, and use of, the services may be terminated by Rviews Press at any time and for any reason unless otherwise indicated in a contract lying Rviews Press to a long-term services such the long-term preservation of the published materials.

By you: if you wish to terminate this agreement, you may immediately stop accessing or using the services at any time.

Automatic upon breach: users’ right to access and use the services (including use of their Rviews Press login service account) automatically upon their breach of any of the terms. For the avoidance of doubt, termination of the terms does not require users to remove or delete any reference to previously-applied Rviews Press tools from their own content.

Survival: the disclaimer of warranties, the limitation of liability, and the jurisdiction and applicable law provisions will survive any termination. The license grants applicable to user contents as well as the long-term preservation of the contents are not impacted by the termination of the terms and shall continue in effect subject to the terms of the applicable license. Their warranties and indemnification obligations will survive for one year after termination.

17. Miscellaneous terms

Choice of law: the terms are governed by and construed by the laws of France and European Union, not including its choice of law rules.

Dispute resolution: the parties agree that any disputes between Rviews Press and users concerning these terms, and/or any of the services may only brought in the competent jurisdiction sitting in France.

  • If users are an authorized agent of a government or intergovernmental entity using the services in their official capacity, including an authorized agent of the federal, state, or local government in the united states, and users are legally restricted from accepting the controlling law, jurisdiction, or venue clauses above, then those clauses do not apply to users. For any such u.s. federal government entities, these terms and any action related thereto will be governed by the laws of the united states of america (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the state of california (excluding its choice of law rules).

No waiver: either party’s failure to insist on or enforce strict performance of any of the terms will not be construed as a waiver of any provision or right.

Severability: if any part of the terms is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

No agency relationship: the parties agree that no joint venture, partnership, employment, or agency relationship exists between users and Rviews Press as a result of the terms or from their use of any of the services.

Integration: these terms and conditions and any applicable additional terms constitute the entire agreement between users and Rviews Press relating to this subject matter and supersede any and all prior communications and/or agreements between users and Rviews Press relating to access and use of the services.
